Terms of service

Version draft-4

Draft. This document has not been reviewed by a lawyer. It will change before Rota AI is offered for sale. The parts in square brackets are not decided yet.

Who provides Rota AI

[To be confirmed: who provides the service. The legal name of the company, its registration number and how to reach it.]

What Rota AI does

Rota AI is a roster builder for hospital and clinic units. You enter your team, your shifts and your rules. It builds a roster that follows them, checks the result again, and lets you share it with your staff.

You are responsible for your rules. Rota AI checks a roster against the rules in your set-up. It does not decide which rules apply to your unit, and it does not give legal advice about working hours.

Your account and your organisation

  • You sign up with an email address, a password and a name for your organisation. The person who signs up is the owner of the organisation.
  • Keep your password to yourself. You are responsible for what is done with your account.
  • You agree to these terms and to the privacy policy when you create an account. We store the version you agreed to and the time.

The data you enter about your staff

You decide what you enter about your staff: their names, their email addresses, their leave and their shifts. You must have the right to enter it and to share rosters with them. The privacy policy says what we store and who else handles it.

A roster you publish can be opened through private links. Anyone who has a link can open the roster it leads to. You choose who gets a link, and you can replace a link at any time.

The free trial

A new organisation has a free trial of 14 days. No card is needed. When the trial ends and no plan has been bought, the organisation becomes read-only: you can still open, download and delete what is there, and you cannot change it. Nothing is deleted because a trial ends.

Paying

  • The plans and their prices are on the pricing page. A plan is paid for by the month.
  • Payments are taken by Stripe. You type your card details into Stripe's own pages, and we do not see or store them.
  • The owner changes the plan, the card or the tax details, and cancels, from the billing page.
  • When the owner cancels from the billing page, the plan runs to the end of the month that is already paid for, and no further payment is taken.
  • We do not give back part of a payment when a subscription is cancelled or an organisation is deleted part-way through a month that is paid for.
  • Nothing in these terms takes away a right to a refund that the Australian Consumer Law gives you.

Deleting your organisation

The owner can delete the organisation at any time. This deletes its units, its rosters and everything else it holds, and it cannot be undone. The privacy policy lists what is deleted and the little that is kept.

If the organisation has a paid subscription, the subscription is cancelled first, at once, so that you are not charged for an organisation that no longer exists. If we cannot cancel it, nothing is deleted and you are told why.

Using the service fairly

  • Do not try to open another organisation's data, to break the service or to slow it down for others.
  • Each plan has limits, which are on the pricing page. The service refuses what goes over them.

What we do not promise

  • We work to keep Rota AI available and correct. We do not promise that it is always available or free of faults.
  • A roster is an aid to your planning. Before you use one, you check it against the awards, the agreements and the laws that apply to your staff.
  • As far as the law allows, we are not liable for loss that follows indirectly from using Rota AI, and our whole liability to your organisation is limited to what it paid us in the 12 months before the claim.
  • Nothing in these terms excludes or limits the consumer guarantees or any other right under the Australian Consumer Law that cannot be excluded or limited.

Changes to these terms

The version of this document is at the top of the page. When we change these terms in a way that matters to you, we email the owner of each organisation at least 30 days before the new version applies.

Which law applies

These terms are governed by the laws of Western Australia. A dispute about them is heard by the courts of Western Australia.
